Terms of Service

1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client”, “Customer”) and Synergy Essential Electrical (“Company”, “we”, “our”, “us”).
By accessing our website, requesting a quote, signing an official quotation, or making payment, you agree to be legally bound by these Terms.
2. Scope of Services
- Electrical installation and maintenance services
- Residential and commercial electrical upgrades
- Solar system consultation and installation
- Inspection and compliance services
- Online preliminary quotations
- Official printed quotations
All services are subject to technical feasibility, site inspection, regulatory approval, and material availability.
3. Contract Formation
A binding contract is formed only when:
- The official printed quotation is signed by the Client;
- Required deposit payment is received and confirmed;
- The Company formally accepts the engagement.
Online estimates alone do not constitute a binding agreement.
4. Pricing & Payment Terms
4.1 Bank Transfer Payments
All payments must be made via bank transfer to the Company’s designated account.
Work shall not commence until cleared funds are confirmed.
4.2 Deposits
A deposit may be required prior to procurement of materials. Deposits are:
- Non-refundable once materials are ordered;
- Non-refundable once labor scheduling has been confirmed;
- Applied toward the final invoice.
4.3 Late Payments
Late payments may incur:
- Interest of up to 5% per month;
- Collection fees;
- Suspension of work without liability to the Company.
5. Refund Policy
5.1 General Refund Conditions
- Deposits are strictly non-refundable once materials are purchased.
- Custom-ordered equipment, including solar panels, inverters, batteries, and mounting systems, are non-refundable.
- Labor costs already incurred are non-refundable.
5.2 Cancellation by Client
If the Client cancels after contract formation:
- The Client remains responsible for materials ordered;
- The Client remains responsible for work completed to date;
- Administrative cancellation fees may apply.
5.3 Refund Processing
Any approved refunds shall be processed within a commercially reasonable timeframe and may be subject to administrative deductions.
6. Client Responsibilities
- Provide accurate property and electrical information;
- Ensure safe and legal access to the property;
- Obtain required permits unless otherwise agreed;
- Disclose known hazards or structural defects.
Failure to comply may result in additional charges or termination.
7. Solar Installation Specific Terms
- Energy production figures are estimates only;
- No guarantee of specific savings or utility reduction;
- System performance depends on environmental and maintenance factors;
- Client responsible for ongoing maintenance.
8. Limitation of Liability
To the fullest extent permitted by law:
- The Company shall not be liable for indirect, incidental, or consequential damages;
- The Company shall not be liable for loss of profits or business interruption;
- The Company shall not be liable for force majeure events;
- Total liability shall not exceed the amount paid for the specific service.
9. Warranty Disclaimer
Manufacturer warranties apply to equipment. The Company does not manufacture equipment and disclaims liability for manufacturer defects.
Workmanship warranties, if provided, will be stated in writing in the official quotation.
10. Force Majeure
The Company shall not be liable for delays or failure to perform due to events beyond its reasonable control, including but not limited to natural disasters, supply chain disruptions, governmental actions, labor shortages, pandemics, or utility interruptions.
11. Indemnification
The Client agrees to indemnify and hold harmless Synergy Essential Electrical against any claims, damages, liabilities, or expenses arising from:
- Client negligence;
- Unauthorized modifications to installed systems;
- Breach of these Terms;
- Misuse of installed equipment.
12. Termination
The Company may terminate services immediately if:
- Payment obligations are not met;
- Unsafe working conditions exist;
- Client breaches these Terms.
13. Dispute Resolution
Any disputes shall first be resolved through good-faith negotiation. If unresolved, disputes shall be subject to binding arbitration in Jamaica, unless otherwise required by law.
14. Governing Law
These Terms shall be governed by the laws of Jamaica. Any legal proceedings shall occur exclusively within Jamaican jurisdiction.
15. Intellectual Property
All drawings, proposals, calculations, and documentation remain the intellectual property of the Company. Unauthorized reproduction is strictly prohibited.
16. Modifications to Terms
The Company reserves the right to modify these Terms at any time. Continued use of services constitutes acceptance of updated Terms.
